Two of the 26 accused arrested in the Baba Siddique murder case have told the court that they want to retract their confession statement as they were ‘involuntarily’ recorded by the Mumbai Police.
An application was filed on their behalf by their lawyer who said they had already apprehended that the police will record their confession statement by force, coercion or undue influence and hence had expressed the same during the first remand on December 3.
The two accused, in their applications, said they wished to retract from the confession and claimed that the investigation authority had recorded their statements to implicate them as there is no evidence. Last month, the Mumbai police invoked charges under the Maharashtra Control of Organised Crime Act (MCOCA) and accordingly took custody of some of the accused. Under MCOCA, confessional statements can be recorded by police officers of a certain rank.
On Monday, the police sought production of five more accused, who are currently in judicial custody for further probe. The rest are in judicial custody till December 30.
Siddique was killed at Bandra in Mumbai on October 12. Police claims that the crime was the handiwork of wanted accused Anmol Bishnoi, whose gang members were part of the conspiracy and execution of the offence.
